Minneapolis Wills and Trusts Attorney
Upon your death, if you have not created a valid will, the state determines which family members get what assets.
There is a legal formula that is used to determine how your assets are distributed if you have not created a will before your death. If you want control over who gets what in your will, you need to create a valid will. I am attorney Andrew J. Howard, and I can easily guide you through this process.
Drafting a Will in Minnesota
Everyone should have a will, but most people do not. Typically, a skilled attorney can have a will drafted for you in one week. Wills are quick to create and inexpensive to set up.
A will is peace of mind. Those in your life are taken care of. Even though it is difficult to think about your own mortality, creating a will is the responsible thing to do.
Minnesota Trust Lawyer
Trusts are often established for minors or others who are unable to make sound financial decisions. There are two main types of trusts:
- Revocable: The person who establishes a revocable trust, or a "living trust," can change his or her mind in the future and make changes to portions of or the entire trust. A revocable trust will automatically become irrevocable upon the trust maker's death.
- Irrevocable: The person who sets up an irrevocable trust cannot modify the terms of the trust in the future. Irrevocable trusts are typically written to protect assets or reduce estate taxes.
Trusts are relatively quick and inexpensive to establish. If you have questions regarding an existing trust or would like to set up a new one, please contact me.
